IMPORTANT - READ CAREFULLY: This Software License Agreement ("Agreement") is a legal agreement between you ("Licensee") and DMwithQAF LLC ("Licensor") for the VPS Uptime Heartbeat Monitor software ("Software").

1. Acceptance

By installing, copying, or using the Software, you agree to be bound by the terms of this Agreement. If you do not agree, do not install or use the Software.

2. License Grant

Licensor grants Licensee a non-exclusive, non-transferable license to install and use the Software on servers owned or controlled by Licensee, subject to the terms of this Agreement and your subscription plan.

3. License Restrictions

Licensee shall not:

• Reverse engineer, decompile, or disassemble the Software
• Modify, adapt, or create derivative works
• Rent, lease, lend, sell, sublicense, or distribute the Software
• Use the Software for any unlawful purpose
• Remove any proprietary notices

4. Term and Termination

This Agreement is effective until terminated. Licensor may terminate this Agreement immediately if Licensee fails to comply with any term. Upon termination, Licensee must cease all use and delete all copies of the Software.

5. Ownership

The Software is licensed, not sold. Licensor retains all right, title, and interest in the Software and any copies.

6. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. LICENSOR DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

7. Limitation of Liability

IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE.

8. Governing Law

This Agreement shall be governed by the laws of the jurisdiction where Licensor is registered.

9. Entire Agreement

This Agreement constitutes the entire agreement between the parties regarding the Software.
